The plaintiff in error, defendant below, was convicted of the crime "of murder in the second degree and sentenced to the state penitentiary for a term of from ten to twelve years at hard labor. Upon the overruling of a motion for a new trial, counsel for defendant interposed a motion in arrest of judgment, for the reason that the information does not state facts sufficient to constitute murder in either degree.
