Appeal from a judgment of the superior court for Kittitas county, Budkin, J\, entered April 1, 1903, upon the verdict of a jury rendered in favor of the defendant, after a trial on the merits, in an action on contract.

In this action the appellant, as assignee of one Peter Costello, sought to recover from the respondent the sum of $43,713.18, alleged to be due for labor and materials) furnished the respondent by Costello in the construction of a certain irrigating ditch or canal, under a written contract entered into between Costello and the respondent.
