The amount of the claim against the estate of decedent involved in this litigation is not in dispute. The Probate Court allowed the claim as of the seventh class; upon appeal the Circuit Court allowed the claim as of the sixth class and the cause is here for review upon the appeal of the executor, contending, as he does, that the claim should have been allowed as of the seventh class and that it was error for the Circuit Court to allow it as of the sixth class.
The cause was tried without the intervention of a jury by the agreement of the parties upon a stipulation as to the facts. The…
