This is an appeal on questions of law from a judgment of the Common Pleas Court of Mercer County, in an action wherein the appellee, George Kuhn, was plaintiff and Lloyd Bader, the appellant, and Otto Murphy were defendants. Defendant Murphy did not appeal.

The action is for damages for personal injuries sustained by plaintiff and alleged to have been caused by the negligence of the defendants.

The material facts in evidence, as disclosed by the bill of exceptions, are as follows:
