In this wrongful death case, the dispositive issue is one of proximate cause. We review a judgment entered against a homeowners’ association in favor of the personal representatives of the estate of a child who was struck and killed by a motorist as the child was riding his bicycle from a pathway located in the common areas owned by the homeowners’ association onto a public street. Because we conclude that there was insufficient evidence as a matter of law to establish that any alleged defects in the pathway and its intersection with the street proximately caused the accident, we will reverse…
