REMAND ORDER

CEREZO, District Judge.

On March 27,1985 the Commonwealth of Puerto Rico, through its Secretary of Transportation and Public Works, filed a petition with the Superior Court of Puerto Rico, San Juan Part, seeking condemnation of portions of a larger parcel of land belonging to the plaintiff in Civil 84-268ICC, for purposes of carrying out Phase II of a mass transit project known as the Agua-Guagua Project, which entails the building of a terminal facility on plaintiff’s property. The sum of $1,023,151.00 was deposited with the court as fair compensation for the properties condemned.…
