BORAH, Circuit Judge.

William West, Sr., brought suit in the state court under the Florida wrongful death statute, 1 to recover damages for the death of his fourteen year old son, Nathaniel, who died instantly as the result of a collision on a public highway between the horse which the decedent was riding and the defendant’s bus. Plaintiff also sought damages for the value of the horse.
