These two cases, consolidated by order of the trial court, were instituted to recover damages for wrongful death in one case, and to recover damages for *730personal injuries in the other case, arising out'of. the same automobile accident. A.-'T. Bateman, as administrator of the estate of Robert G. Diaz, deceased, was plaintiff in the first action, representing the deceased’s widow and infant child, and Samuel B.
