FOSTER, Circuit Judge.
Appellee brought suit on a policy of war risk insurance in the sum of $10,000' issued to him as a soldier, alleging total and permanent disability at the time of his discharge. Error is assigned to the refusal of a directed verdict for defendant at the elose of the evidence.
It appears that the original policy lapsed for nonpayment of premiums on January 31, 1919. In 1927 the insurance was reinstated and converted into a five-year term policy, which was in force at the time suit was filed. The insured elected to sue under the original policy and for the recovery of…
