The appellant, O. C. McNair, was convicted in the Circuit Court of Rankin County of the murder of W. L. Mullican, and was sentenced to death. From this judgment he appeals.
Appellant spent the morning of May 1, 1951, in various activities involving drinking and gambling in and about Rankin and Hinds Counties, which, sometime in the early afternoon of said date, terminated in a fight between the appellant and two of his companions.
