The accused was convicted of murder, and sentenced to life imprisonment. His motion for a new trial having been overruled, he excepted.

It appears from the motion for a new trial that after the jury had been-for some time deliberating, the judge sent for them and inquired if they had agreed upon a verdict or were likely to .agree.
