In an action for a judgment declaring that the defendant is obligated to defend and indemnify the plaintiff in an underlying action entitled Pfister v 44 Crosby St. Realty, LLC, pending in the Supreme Court, Kings County, under index No. 36660/06, the plaintiff appeals from an order of the Supreme Court, Queens County (McDonald, J.), dated February 23, 2009, which *1111granted the defendant’s motion for summary judgment declaring that it is not so obligated.
