dissenting.

¶ 44 I respectfully dissent because, in my view, the majority has painstakingly built a straw man on the bleached bones of Harris v. Balk, and then knocked it down, without addressing what I believe is the true issue at hand. In doing so, the court avoids grappling with the key feature of the jurisdictional question presented: the implication of a relatively new species of intangible property that has no singular location.
