This is a prosecution for murder. At about 8:30 a. m. on January 31, 1959 appellant, a 37 year old Negro resident of Opelousas, Louisiana, went to the home of a neighbor, a Negro woman named Virgie Lee Thibodeaux, and obtained her consent to have her 1U/2 year old daughter, Joyce Marie Thibodeaux, work for him several hours at his nearby home, stating that his wife was an invalid.
