FORD, Chief Judge.

This case is submitted for judgment upon the motion of the defendant Oscar James Jackson to dismiss an indictment pending in this Court against him on the ground that he has been denied a speedy trial in violation of his rights under the Sixth Amendment of the Constitution of the United States.

It appears from the defendant’s motion that since the return of the indictment on January 10, 1955, he has been incarcerated in the Kentucky State Penitentiary at Eddyville, Lyon County, Ky. The defendant has not completed service of the State sentence imposed upon him and he has not…
