Appellant was charged with three violations of Article 134, Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 934 (2000): (1) possession of visual depictions of minors engaging in sexually explicit conduct; (2) committing an indecent act upon his eleven-year-old stepdaughter while his wife was out of town; (3) and committing an indecent act of a sexual nature with his wife.
