On April 9, 1978, a security guard was shot five times and killed at a McDonald’s restaurant in Chicago. On April 14, 1978, defendant was arrested in Chicago for a parole violation unrelated to this shooting and taken to the Joliet penitentiary. On April 18, 1978, an eyewitness to the shooting selected defendant’s picture from a police mug book as the assailant. On April 21, 1978, defendant was brought from the Joliet Penitentiary to Chicago for a lineup pursuant to a writ of habeas corpus ad testificandum, issued by a circuit court judge in Cook County upon petition of the state’s attorney.…
