The prisoner was indicted and found guilty of the murder- of one Donaho. A motion was made for a new trial for the following reasons : 1st. Because the verdict of the jury is contrary to law and evidence; 2d. That the court improperly released and dismissed two of the jurors who had been summoned under the special venire, against the consent and remonstrance of the prisoner; and 3d. Persons, not of the jury, were permitted to visit and mingle with the jury, after the cause had been submitted to them and they had retired to consider of their verdict.
