In two related actions, inter alia, to recover damages for breach of a partnership agreement and conversion of partnership funds, Spencer Gaines and Jacqueline Nalitt, co-executors of the estate of Sanford Nalitt, appeal from so much of a judgment of the Supreme Court, Rockland County (Meehan, J.), dated May 18, 1995, as, upon an order of the same court dated May 4, 1995, which, inter alia, granted the plaintiffs’ motion for partial summary judgment on the first cause of action in Action No. 2, is in favor of the plaintiffs and against them in the principal sum of $213,957.
