On September 3, 1873, the complainant, with T. IT.' Gardner, R. E. Gardner, T. J. Gardner, and R. B. Daniel, executed a note to the defendant, due at one day, for §2,500, signing his name as surety. On January 25, 1876, the defendant brought suit on the note against all the makers by writ returnable to the February term of the circuit court. At that term the pleadings were made .up, but before the next term, and about the first of June, all of the makers of the note except complainant went into voluntary bankruptcy.
