Prior to the commencement of this action, and on or about February 20, 1928, the defendants together with the plaintiff executed a promissory note wherein the said defendants and the plaintiff promised "jointly and severally to pay the sum of $300 to the Community Loan System, Inc., fifty-two weeks after date. Of the above amount $50 was paid, and the balance of $250, with interest and costs, was paid by the plaintiff on or about November 14, 1928.
