This action was brought by Rosie Alexander, respondent, against Durham Life Insurance Company, appellant, in the Court of Common Pleas for Anderson County on July 17, 1935, for the fraudulent breach of an insurance contract issued her by said insurance company. The policy of insurance was issued on April 16, 1923, and provides for the payment of weekly premiums in the amount of 20 cents, 20 per cent, of which premium was for life insurance benefits, and 80 per cent, of which was for disability insurance from sickness and accidents.…
