WARE, District Judge.

This is in substance a bill in equity seeking damages for an alleged fraud and misrepresentation, in the sale and assignment of a right of pre-emption of certain lands in this state. A preliminary question is presented, and was discussed at the argument, as to the admissibility of Web-ber as a witness in the cause. His deposition was taken, subject to the objection made when the interrogatories were filed.
