Plaintiff has appealed from an order setting aside a verdict in his favor and granting a new trial in an action to recover damages for personal injuries.

The record discloses the following facts: On July 13, 1950, the day of the accident out of which this action arose, plaintiff, C. F. Zickrick, was engaged as an independent contractor in hauling logs by truck from the logging operation of a concern referred to as Rasor Logging Company to the mill.
