This case has resulted from a traffic accident occurring on highway US-12 in Kalamazoo county, in which plaintiff sustained personal injuries. Prior to the occurrence in question plaintiff and his wife were engaged in operating a restaurant on the south side of said highway between Gales-burg and Comstock. On the 30th of July, 1950, they left their place of business shortly before midnight. It was their intention to drive to their home, a short distance away.
