Error to superior court of Grand Rapids. (Burlingame, J.) Respondent was convicted of a violation of 3 How. Stat. 93146, and sentenced to imprisonment in the State prison for. eight years. Judgment reversed, and a new trial granted. The facts are stated in the opinion.

Kespondent was convicted on an information charging him with having made an assault on one Elsie Hoertz, a female child of the age of eight years, and taking indecent and improper liberties with her person.

The prosecution was brought under section 93143, 3 How. Stat., which provides:

“If any male person or persons over the age of 14 years shall assault a female child under the age of 14 years, and shall take indecent and improper liberties with the person of such child, without committing or intending to commit the crime of .rape upon such child, he shall be deemed a felonious assaulter, and…
