This is the second time this case comes before us. Defendant Steven R. Speed was charged by information in Ogle County with indecent liberties and rape. (Ill. Rev. Stat. 1981, ch. 38, pars. 11— 4(a)(3), 11 — 1(a).) Following a bench trial, he was found guilty of rape and sentenced to a 12-year term of imprisonment in the Department of Corrections. In a Rule 23 order issued by this court upon defendant’s first appeal, defendant’s conviction for rape was affirmed, but his sentence was reversed and remanded due to the trial court’s improper consideration of a factor in aggravation; namely, that…
