*903In an action, inter alia, to recover damages for breach of contract and to foreclose a mechanic’s lien, the defendants appeal from an order of the Supreme Court, Rockland County (Walsh II, J.), dated August 9, 2010, which denied their motion, among other things, pursuant to CPLR 3211 (a) (1) and (5) to dismiss the complaint and vacate the mechanic’s lien, and for summary judgment on their first counterclaim.
Ordered that the order is affirmed, with costs.
