Counter-motions are made, one by the plaintiff to examine before trial the defendant corporation by three of its *649officers; the other by defendant to stay all proceedings in this action because of non-payment of costs allegedly imposed against the plaintiff in another action in which, defendant asserts, identical relief was sought.
