MEMORANDUM OP DECISION

This matter came before the Court on the Creditor’s Motion to Terminate Section 362(a) Stay and Objection to Confirmation in six separate cases. (One of which has been dismissed so that this dismissed case is not considered in this opinion). 1 The creditor’s attorney, the attorneys for the debtors, the standing trustee and a specially appointed attorney all participated in the trial on the merits and submitted briefs in support of their positions. All parties desired to have the ultimate issue as to whether or not the transaction was a true lease or a disguised security…
