Statement of the Case.

NICHOLLS, J.

The petition in this case was filed on April 7, 1902. In it plaintiff alleged: That Joseph A. Schenck, on or about the -;— days of August, September, October, November, and December, 1901, at various dates within a year prior to this suit, and in the present year, unlawfully trespassed upon the land of petitioner and cut thereon the standing timber, forestry timber, and removed and hauled and shipped away the said timber from petitioner’s property, and continued unlawfully to trespass upon and commit damage upon the said land and property of petitioner.
