The instant litigation involves a claim of employment discrimination filed by the ap-pellee, Emmanuel Bailey, against the appellant, Federal National Mortgage Association (“Fannie Mae” or “employer”). In response to Mr. Bailey’s complaint, Fannie Mae filed a motion to stay litigation pending arbitration. The District Court denied the motion to stay, and Fannie Mae now appeals.
