delivered the opinion of. the court.

This was a suit by defendant in error to recover damages for personal injuries sustained by him, while in the employ of plaintiff in error, on July 4, 1902. Upon trial the jury returned a verdict in favor of defendant in emu;, assessing his damages at $3,000. Motions for a new trial and in arrest of judgment were overruled and judgment entered for the amount of the verdict.
