Szajnecki was a member of the Polish Union of America, a fraternal beneficial association. In 1915 the society-issued a certificate to him in which his brother^ the plaintiff herein was named beneficiary. Afterwards the insured with the consent of his brother, the beneficiary, agreed with Maryanna Szajnecki the defendant that if she would marry him he would substitute her as the beneficiary. A few days after this arrangement was made they were married but the husband being killed within four days, the contract as to the insurance was never carried out. The brother named…
