I. Introduction.

Pending before the court is Plaintiff Atlantic National Trust, LLC’s (“Atlantic National’s”) motion for summary judgment against Defendant R. Brent Gunderson (“Gunderson”). On May 25, 2000, Magistrate Judge Stewart issued her findings and recommendation that the motion be denied. 1 Atlantic National objects to the findings and recommendation.
