On the eighteenth day pf April, 1878, the plaintiff commenced an action in the district court of Saunders county, against the defendant, to have certain taxes upon “ Twenty feet off the west side of lot 2, in block 31, in that part of Ashland formerly called Flora City,” declared null and void, and to. have the county treasurer, Anderson, enjoined from executing a tax deed to Smith under a sale of said premises for said taxes.
