This is a writ of error to a judgment of the Superior Court of Monroe County. The plaintiff, Josiah Hudgins, was indicted for the murder of John Anderson. On the trial John Ross, one of the tales jurors, being sworn upon his voire dire, under the Act of 1843, answered, “ that he had not heard any part of the evidence given under oath, nor had he seen the crime committed, but had formed an opinim'from rumour.” Defendant’s counsel moved to reject the juror, which motion was overruled, and the juror peremptorily challenged by the prisoner.
