This action was brought to recover the purchase price of two certificates -of sale of real estate issued by the defendant city upon sales for delinquent *475municipal taxes. These certificates were issued by the city treasurer of said city, and transferred to plaintiff under Ordinance Bo. 781. .Plaintiff alleges that these certificates were illegally and erroneously issued upon an invalid assessment, setting out the invalidity; that such illegality was discovered in April, 1900, and that he thereupon demanded cancellation of such certificates,…
