This was an action of assumpsit, brought by appellee, in the Circuit Court of Cook county, against appellant, to recover damages for an alleged breach of a contract of marriage. The declaration contained several counts, stating the contract in different modes, and a promise to marry at different times. Appellant filed the general issue. Subsequently the venue was changed from Cook, to the Circuit Court of Du Page county, and a trial was had in the latter county, before the court and a jury, resulting in a verdict and judgment in favor of plaintiff below.
