Certiorari from Wapello District Court. — Hon. Francis M. Hunter, Judge. Certiorari proceeding brought in this court to test the legality of the action of the district court of Wapello County (the defendant judge presiding) in the case of Goudy v. Timonds pending in such court. The alleged illegality complained of 'is that the defendant judge denied the petitioner herein (defendant in that case) the right of trial by jury and refused to call the jury in such case upon the petitioner’s demand therefor and compelled a hearing of the case before the court without a jury.

— The case of Goudy v. Timonds was a proceeding brought in the Wapello county district court under Secs. 3219 and 3220, whereby it was sought to have a guardian appointed for the defendant therein on the ground that he was of unsound mind. The petitioner herein is the defendant therein and his daughters are the plaintiffs therein. The petition was filed on January 8, 1914. An order appointing a temporary guardian was entered without notice. The case was brought for the March term of court, to begin March 23rd.
