Appeal by the defendant, Rachel G. Rice, from a judgment .of the Supreme Court in favor of the' plaintiff, entered in the office of the clerk of the county of Suffolk on the 13th day of October, 1898, upon the verdict of a jury, and also from an order bearing date the 6th day of October, 1898, and entered in said clerk’s office, denying, the defendant’s motion for a new trial made upon the minutes.

This action was brought upon an instrument in writing, of which ■ the following is a copy :

“ For value received, I promise to pay Oliver James Rice, or order, the sum of fifteen hundred dollars when he is twenty-one years of age, with interest from date.
“RACHEL G. RICE.
“ Mount Morris, January lszi, 1890.
“ Witness: John Milliman.”
