McENTEE, Circuit Judge.
In this proceeding petitioner, a deport-able alien, seeks review of an Immigration Appeals Board order denying him suspension of deportation. Petitioner, a native and citizen of China, entered the United States illegally in May 1959 with the intention of permanently remaining here. In April 1964 after a hearing before a special inquiry officer on deportation charges, he declined the privilege of voluntary departure and was ordered deported. He did not appeal this order but through a series of dilatory tactics has managed to remain in this country.
