Claimant seeks damages for his alleged false imprisonment in State prison at Elmira during the period from December 9, 1936, to December 7, 1943.

On October 29, 1930, he was convicted of grand larceny, second degree, in Clinton County Court, and was sentenced to *740Elmira Reformatory, said sentence being suspended, and the claimant was placed on probation for one year. On December 9, 1936, claimant was convicted of forgery in the second degree in the Clinton County Court.
