FOSTER, Circuit Judge.

Two indictments were returned in the Southern district of Florida, the first district into which he was brought, against James Horace Alderman, appellant — one charging him with the murder of Victor A. Lamby, by shooting him with a pistol upon the high seas, on a vessel owned by the United States; and the other charging him with the murder of Sidney C. Sanderlin by the same means and at the same time and place. By agreement the indictments were consolidated and tried together.
