This is an original proceeding by writ of habeas corpus and ancillary writ of certiorari to test the legality of the present detention of the defendant, Macario Cobos, in the State prison of southern Michigan.

Upon his conviction in the recorder’s court for the city of Detroit of the crime of taking indecent liberties with a female child defendant was placed on probation on May 29, 1947, for a period of 3 years.
