dissenting.—This is an action of ejectment for a lot of ground, situate in the borough of York, containing about two acres, with a brick church, a two-story dwelling-house, and a frame stable thereon. The plaintiffs claim to be incorporated under a charter certified by the governor of this commonwealth, on the 7th of December 1813; and, as such incorporation, they also allege that they are entitled to the possession of the property in question.
