In this case, we consider the constitutionality of statutory conditions on the suitability of a civilly committed sexually violent predator for the transitional release program. As part of an annual review, the district court denied a final hearing for discharge or suitability for placement in a transitional release program to David Taft based in part on his failure to fulfill statutory criteria for a finding of suitability for a transitional release program.
