OPINION

MURRAY, Justice.

This case is before the court on the appeal of the defendant, the State of Rhode Island, Department of Corrections (state), from a Superior Court declaratory judgment in favor of the plaintiff, Salvatore G. Terrano (Terrano). The state asserts that the trial justice erred in finding that Rhode Island State Marshals are police officers within the intended scope of G.L.1956 (1980 Reenactment) § 45-19-1 and that, as such, they are eligible to receive the full pay and medical-expense benefits to which the statute alludes.
