In an action to recover payment for goods sold and delivered based on an account stated, the plaintiff appeals from so much of an order of the Supreme Court, Kings County (Gigante, J.), dated May 17, 2001, as denied its motion for summary judgment, and the defendant cross-appeals, as limited by its brief, from so much of the same order as denied its cross motion for summary judgment dismissing the complaint.
Ordered that the order is reversed insofar as appealed from, the motion is granted, and the matter is remitted to the Supreme Court, Kings County, to substitute the New York City Health…
