This suit was filed by the plaintiff, Mrs. Una Claire Fried, duly authorized by her husband, Julius P. Fried, against the defendant, an absentee, to try title to certain real estate under Act 38 of 1908. The suit was originally brought under the provisions of Act 106 of 1934 and while it was pending in the district court this Court rendered its decision in the case of Doll v. Meyer, 214 La. 444, 38 So.2d 69, holding, on rehearing, that the constitutional provisions, Section 11, Article 10 of the Constitution of Louisiana of 1921 governing *526tax sales and Act 106 of 1934…
